Michael Jordan Tells Court He Felt No Fear of the Racing Body in Legal Battle

The basketball icon, as he cordially introduced himself in a Charlotte court on Friday, stated that his competitive side and novelty within the sport emboldened his push for 23XI Racing to confront Nascar over alleged violations of competition laws.

Financial Stakes and a Competitive Drive

Jordan shared operational insights of his racing venture, revealing he invested $40 million of his own funds into the Cup Series operation launched with partner Polk and driver Hamlin.

“It fell to someone to act,” Jordan said in the Charlotte courtroom. “I was a new person, I wasn’t afraid. I believed I could take on Nascar as a whole. From my perspective, the sport it needed to be looked at from a different view.”

The Core Dispute: Franchise System and Renewal Demands

At issue is the expiration of a 2016 deal where Nascar provided each team a franchise. The concept is similar to other professional sports with independent franchises, such as the NBA’s Hornets or the NFL’s Panthers. This deal was due to end in 2024 when Nascar demanded charter membership renewals.

Jordan testified for about sixty minutes and left the court to a media frenzy, with fans and media clamoring for a glimpse or a picture of the sports legend.

Spearheading the Fight

Jordan’s 23XI is leading the full-court press along with Front Row Motorsports for Nascar to overhaul a business model Jordan contended is breaking the law to maintain excessive control.

For Jordan and and Heather Gibbs, who testified before Jordan, are details from September 2024. She recounted a frantic and emotional six hours where the sanctioning body informed teams they must sign a charter agreement extension. This agreement consists of 112 pages outlining team compensation and a guaranteed entry in every race.

Choosing Litigation

Jordan explained that his team and its ally decided their only feasible option was to decline to sign that extensive document and litigate the matter. The other 13 organizations signed the agreement.

The team owners reached out to Nascar about potential amendments or extension options. Nascar wasn’t talking, Jordan said.

The Bottom Line: Winning

Ultimately, the pushback against what he saw as a unsustainable system was driven by the familiar goal for Jordan: Winning.

“Denny convinced me adding a third car improved our chances to win,” he said, noting that he bought a third charter late in 2024 for $28m amid the legal dispute. “So I took the plunge.”

Account from the Gibbs Family

Heather Gibbs detailed her request for permanent charters, submitted in a written letter to Nascar. She said the pressure of the signature deadline was problematic.

According to her, the team founder first attempted to call and persuade Nascar against demanding signatures, but Nascar’s leader declined the request.

“Don’t do this to us,” Gibbs recounted Joe Gibbs told Nascar’s executives. The response was, “Whether I have 20 charters, that’s what I have. If I have 30, that’s the number.”
